TERMS AND CONDITIONS
SCHEDULING:
All therapy sessions are scheduled through Safe Space Therapy easy online calendar a minimum of forty-eight (48) hours in advance or via email/SMS to the head practitioner Jessica Levi.
In order to accommodate your ideal appointment times, we strongly advise you to schedule all paid sessions as far in advance as possible immediately after remitting your payment.
PAYMENTS:
All payments/deposits are non-refundable. Sessions are booked in advance.
A deposit of $60 is required to secure your booking.
Payments can be made via banking transfer or through the secure online portal.
If an alternative method of payment is necessary, kindly schedule a call with Jessica to discuss possibilities.
SESSION & COMMUNICATION EXPECTATIONS FOR SESSIONS:
It is the client's responsibility to book their sessions. Please arrive ON TIME (either in person, or telehealth call) at your scheduled appointment. Sessions started late may need to be ended at the scheduled time in consideration of those with appointments following your session.
TERMS & CONDITIONS FOR SUPPLY OF SERVICES Safe Space Therapy
1 INTERPRETATION
In this document the following words shall have the following meanings:
1.1 "Client" means any person who purchases Services from the Therapist;
1.2 “Services” means the provision of therapy in a single Session or a Programme consisting of multiple Sessions, as tailored for the Client by Safe Space Therapy;
1.3 “Agreed Payment” means the amount to be paid by the Client for the Session or Programme as agreed when the Session or Programme is discussed and organised, and as confirmed in writing by Safe Space Therapy.
1.4 "Terms and Conditions" means the terms and conditions of supply set out in this document and any special terms and conditions agreed in writing by Safe Space Therapy
2 GENERAL
2.1 These Terms and Conditions shall apply to all contracts for the supply of Services by Safe Space Therapy. By paying the Agreed Payment, the Client acknowledges and agrees to these Terms and Conditions.
2.2 These Terms and Conditions shall apply once a Client has made the Agreed Payment for the relevant Session or Programme to Safe Space Therapy.
2.3 These Terms and Conditions may be varied, but only if so agreed in writing by Safe Space Therapy.
3 AGREED PAYMENT AND PAYMENT
3.1 Payment of the Agreed Payment part payment for a Session shall be made prior to the Session. If the Agreed Payment is not received at the time of the session, the session will not proceed. Unless payment is made prior to the client leaving the session and prior approval.
3.2 Payment of the Agreed Payment for a Programme consisting of multiple Sessions, shall be made as agreed by Safe Space Therapy and Client when arranging that Programme.
3.3 Safe Space Therapy reserves the right to charge a Deposit for a session or program.
3.4 Payments shall be made to the bank account, or via the payment link or in person.
3.5 The Client agrees to include their name as a payment reference to allow the Safe Space Therapy to identify the payment from the Client.
3.6 The preferred payment option is electronic funds transfer (EFT) to the account provided in the welcome message. Alternatively, an online portal via SQUARE l is also acceptable. SQUARE charges a 1.9% fee which is passed through to the Client so should you elect this option, this fee is added to the Agreed Payment.
4 LATE CANCELLATIONS AND NO SHOW
4.1 Cancellations and/or rescheduled appointments will be accepted if made at least 24 hours prior to the appointment.
4.2 Full payment of session will be charged via the nominated credit card where:
(i) cancellation is less than 24 hours prior to the relevant appointment; or
(ii) the Client does not show-up for the relevant appointment.
5 REFUNDS
5.1 There are no refunds. Any exception to this policy is solely at the discretion of Safe Space Therapy.
5.2 All potential Clients are invited to ask questions regarding the Service of Therapy if they are unsure what a session involves or what to expect.
6 PUNCTUALITY
The parties acknowledge that delays can be part of life and agree that: If a client is late by 30 minutes or by half the scheduled session time, whichever is lesser, the session will be cancelled. Should the client be delayed, they acknowledge that the missed time will be forfeited and not compensated at the end of the session. Conversely, if the therapist is delayed, the missed time will be added to the current session. In the event that the client is unable to extend beyond the scheduled session time, the additional minutes will be carried over to the subsequent session
7 INTELLECTUAL PROPERTY
7.1 Client acknowledges that the content and method of delivery of the Services is intellectual property of Safe Space Therapy and shall not be replicated, copied, distributed or sold in breach of the clause.
7.2 Any written material produced by Safe Space Therapy is subject to copyright protection. The Client acknowledges that Safe Space Therapy has not and will not waive this copyright protection and the Client specifically acknowledges that such written materials will not be copied for the purpose of distribution or otherwise without consent of Safe Space Therapy.
8 CONFIDENTIALITY/PRIVACY
8.1 Safe Space TherapySydney is bound by the Australian Privacy Principles (APP) as set out in the Commonwealth Privacy Act, 1988 as amended. In keeping with this legislation, this Privacy Notice summarises Safe Space Therapy ’s practice in the collection, use and disclosure of your personal information. Safe Space Therapy Sydney respects your right to privacy and is committed to ensuring the privacy of any personal information you give us.
8.2 Information shared by the Client within a session is subject to strict confidentiality. The parties expressly acknowledge this for the purpose of creating a safe haven & healing space.
9 LIABILITY
9.1 By paying for a Session or Program, the Client automatically waives, releases and discharges from any and all liability, including but not limited to negligence or fault of Safe Space Therapy, for death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to the Client or his or her property, including travelling to or from a Session.
9.2 The Client indemnifies and holds Safe Space Therapy and her affiliates or employees harmless and will not sue them for negligence or otherwise.
9.3 Safe Space Therapy is not a licensed Medical Practice and therefore does not diagnose, prescribe or treat diseases or illnesses. The Services are for informational or educational purposes only. Always seek the advice of your doctor or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of information you accessed through any Session or Program. It is the intention of Safe Space Therapy to provide professional therapeutic mental health or other services aligned with the highest level of integrity and professionalism and guarantees and warranties of any kind cannot be and will not be given or promised.
10 HARASSMENT
10.1 The parties acknowledge that harassment of any kind, that being aggressive, sexual or anti-social behaviour, will not be implemented or tolerated by either party.
10.2 Safe Space Therapy is committed to upholding values of integrity and mutual respect, which includes zero tolerance towards harassment and any behaviour that is out of alignment with integrity.
10.3 Safe Space Therapy and its staff are committed to creating a safe and enjoyable environment where healing can take place and wellness can begin.
12 SEVERANCE
If any term or provision of these Terms and Conditions is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if these Terms and Conditions had been agreed with the invalid, illegal or unenforceable provision eliminated.
13 GOVERNING LAW
These Terms and Conditions shall be governed by and construed in accordance with the law of Australia and the parties hereby submit to the exclusive jurisdiction of the Australian courts.
INSURANCE
As a Qualified Clinical Hypnotherapist and Psychotherapist Safe Space Therapy has to have up to date insurance.
RELEASE OF LIABILITY:
As the Client, I understand that these sessions are consultative in nature and that any actions and decisions made by me are solely my responsibility. is in no way be held liable or responsible for any actions taken, or not taken, by me. Safe Space Therapy makes neither guarantees nor warranties, expressed or implied, about any results to be achieved.
FREEZE POLICY:
Safe Space Therapy acknowledges the potential for unforeseen circumstances impacting clients' ability to attend scheduled sessions. Clients who have pre-paid for services are afforded the opportunity to "freeze" their sessions, deferring the utilization of remaining sessions to a mutually agreed-upon future date. This arrangement is contingent upon the provision of written notice to Jessica@safespacetherapy.com.au. It is imperative to emphasize that all sessions must be consumed within a six-month period from the initial date of purchase, in accordance with the terms and conditions outlined in the client agreement.
